NHTSA received a petition on or about July 18, 2022, requesting that Federal Motor Vehicle Safety Standard (FMVSS) 141 be applied to all electric and hybrid vehicles operating in the United States. The petition can be reviewed at NHTSA.gov under ODI Number 11486072. FMVSS 141 establishes performance requirements for pedestrian alert sounds for motor vehicles. The standard applies to hybrid and electric vehicles that have a gross vehicle weight rating of 4,536 KG or less or are defined as low-speed vehicles. The standard became fully applicable to all such vehicles manufactured on or after March 1, 2021.On January 27, 2023, NHTSA opened Defect Petition (DP) 22-005 to evaluate the subject matter described in the petition. On June 24, 2023 and as supplemented on June 25, 2023, the petitioner notified NHTSA he was withdrawing his petition. The petitioner indicated that, based on his review of data, there is no justification for asserting potential benefits that could be derived from actions sought by my petition. Based on the petitioner's withdrawal, DP22-005 is closed. Closure of this DP does not represent a determination by NHTSA regarding the subject matter of the petition.

I PULLED INTO MY PARKING SPOT IN MY CONDOMINIUM COMPLEX, WITH MY FOOT ON THE BRAKE PEDAL (AT ZERO MPH). AS I WAS TRYING TO PUT IT INTO PARK, THE VEHICLE SUDDENLY LURCHED FORWARD AND JUMPED INTO THE HILLY WOODS. I PRESSED HARDER ON THE BRAKE PEDAL BUT IT WOULD NOT STOP OR SLOW DOWN AND I WASN'T ABLE TO CONTROL THE STEERING. THE CAR CONTINUED GOING THROUGH THE HILL FULL OF LARGE TREES. FINALLY THE VEHICLE ONLY STOPPED WHEN IT CRASHED INTO A TREE. I HAD A HARD TIME OPENING THE DOOR TO GET OUT OF THE CAR BECAUSE IT WAS WEDGED AGAINST SAID TREE. IF THE CAR DIDN'T CRASH INTO THE TREE, IT WOULD HAVE CONTINUED DOWN THE EMBANKMENT TO CRASH INTO 5 CARS BELOW AND THE RESULTS WOULD'VE BEEN MORE

As a result, the vehicle failed to start. The contact stated that unknown warning lights were illuminated but turned off after the battery was on charge mode. The contact owns a 2017 Toyota Rav4 Hybrid. The contact stated while driving 50 MPH, he attempted to avoid a rock but was unsuccessful. The contact stated that rock struck the fuel neck and caused a substantial fuel leak, 13/8 hose was unprotected and cut. A fellow motorist alerted the contact of the failure. The contact inspected the vehicle and found the leak. The contact temporarily fixed the leak and drove to the residence. The contact ordered a new filler neck and repaired the failure.
